Terms and Conditions for The Ryder Cup Giveaway

Entries must be received by 01/10/2023 23:59 BST. Winner will be selected at random and notified via DM no later than 09/10/2023. Repost bonus entries must be public. No purchase or payment necessary - UK delivery is free of charge, overseas delivery costs (if applicable) may be charged to the winner at our discretion. By entering, entrants confirm that they are 16+ years of age, release Instagram and Facebook of responsibility, and agree to Instagram's terms of use.

Terms of entry:

Entries are limited to one per Instagram account.
You do not need to make a purchase to enter the Giveaway.
We accept no responsibility for entries that are lost, delayed, mislaid or damaged in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction or network error.
We may in our sole discretion reject any entry that we consider contains any of the following: (i) false, incomplete or misleading information; (ii) inappropriate or offensive content; (iii) content that we believe could cause harm to us or our brands, products or services; or (iv) content that breaches any of Instagram’s platform policies.

The Prize

The prize is the following (each, a “Prize”):
- Official 2023 Ryder Cup beanie;
- a Clutch putter headcover (of the winner's choice);
- a Clutch microfibre towel (of the winner's choice);
- a Clutch drawstring bag.
The Prizes are provided ‘as is’ and ‘as available’ and, to the extent permitted by applicable laws and regulations, made available without any representations, warranties or guarantees of any kind.
Insofar as is permitted by law, we will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by our negligence. Your statutory rights are not affected.

Winner Notification

We will contact the winner by messaging the Instagram account where their entry was posted. If you win, you must respond and confirm where you would like the Prizes to be delivered within seven (7) calendar days of us first contacting you. If you either fail to respond or fail to provide your delivery details within this time, or if you otherwise decline the Prizes, we may disqualify your entry and draw another winner.
We will promptly dispatch the Prizes to the winner after they have confirmed their delivery details. The winner should allow 30 days from providing their delivery details to receive their Prizes.
We shall publish details of the winner of the Giveaway (using the entrant's Instagram handle) as a post or a story on @clutchgolfofficial for a reasonable period of time following the end of the Giveaway. The winning entrant may object to the disclosure of this information by informing us when we contact them to confirm that they have won. We reserve the right to make the winner’s details available to the Advertising Standards Authority if we are requested to do so.

Data Protection and Publicity

By entering the Giveaway, you agree that we may use your personal data for the purpose of administering the Giveaway and in accordance with our Privacy Policy, which can be found at https://www.clutchgolf.co.uk/privacy-policy
By entering the Giveaway, you agree that we may, at our discretion, use your name, Instagram handle and any post / story that you share to your Instagram account for promotional purposes and to announce the winner of the Giveaway.

General

We may exclude you from entering the Giveaway or void your entry if we reasonably believe that you have breached these terms and conditions or you have engaged in conduct that might otherwise bring the Giveaway into disrepute. Any decision that we make as to your eligibility to enter into the Giveaway is final.
You acknowledge and accept that the Giveaway is not sponsored, endorsed or administered by Instagram, Facebook or the brands mentioned. You acknowledge and accept that Instagram has no liability to you for the Giveaway and fully release Instagram from any liability in connection with the Giveaway.
We reserve the right to suspend, cancel, postpone or amend the Giveaway where it becomes necessary to do so, with no liability to any entrants or third parties.
The Giveaway and all issues arising out of it shall be governed in accordance with English Law and are subject to the jurisdiction of the English courts.
